If you are purchasing a property to go alongside the main residence you already own, and do not intend to use it for commercial use, you will have to pay a 3% surcharge on top of the normal SDLT rates.

Even if you are renting the property out and not using it yourself, you are liable to pay the SDLT surcharge. Exceptions for this rule would be if it were a property above a shop that was rented as one, meaning it would fall under mixed-use. This is where you would receive SDLT relief once evidence is provided to HMRC.

If you purchased a second home and paid the 3% surcharge, but later sold your main residence, you will be eligible for a refund… if you sold the first property within three years of paying your surcharged SDLT bill.

  • What can I get a Stamp Duty Refund for?
    The reality of Stamp Duty is that it’s a tax that you are required to pay, it usually takes a tax specialist to make sure everything is calculated correctly, especially if you own multiple properties (residential and non-residential) or land.
